MindX Ltd (“MindX”, “Company”, “we”, “us” or “our”) is fully committed to your privacy.

This Privacy Policy covers our treatment of personally identifiable information (“Personal Information”, as more fully defined below) that we gather when you are a) accessing the MindX website, mindx.co, and/or any subdomains thereof (the “Sites”), b) downloading and installing the MindX application for mobile devices (the “App”), and/or c) using any of the Services MindX provides (the “Services”). This policy does not apply to processes we do not control, or to individuals that we do not employ or manage.

BY VISITING THE SITES, INSTALLING THE APP, AN/OR USING THE SERVICES YOU REPRESENT AND WARRANT THAT YOU HAVE READ AND UNDERSTOOD, AND AGREE TO THE TERMS OF, THIS PRIVACY POLICY. IF YOU DO NOT UNDERSTAND OR DO NOT AGREE TO BE BOUND BY THIS PRIVACY POLICY, YOU MUST IMMEDIATELY STOP USING MINDX.

INFORMATION WE COLLECT FROM YOU

We gather information which enables us to personalize and improve our Services as well as information that enables us to provide our Services. We collect the following types of information from our customers:

Information You Provide to Us

In order for you to use certain of our Services, you may be asked to provide to us certain Personal Information. Personal Information includes, without limitation: (1) “Contact Data” (such as your name and e-mail address); (2) “Financial Data” (such as your account or credit card number); (3) “Demographic Data” (such as you age and zip code); and (4) “Auxiliary Data” (such as your level of education, work experience, leadership responsibilities and accomplishments, skills, short biography description, or picture). In each case, you will be asked to provide Personal Information; the Sites or the App will not gather it surreptitiously. We may supplement the Personal Information you provide with additional Personal Information gathered from public sources or from third-parties (e.g., consumer reporting agencies) who may lawfully provide such information to us. You are under no obligation to provide Personal Information, with the caveat that your refusal to do so may prevent you from using certain of our Services or get assessed for a specific job opportunity.

Information We Collect about You and Your Device

We may receive and store certain types of information whenever you interact with our Sites, App or Services. We automatically receive and record information on our server logs from your browser or mobile system including your IP address, Company cookie information, the page you requested and game, test and training program data.

When you use our games, tests and training programs, we collect your behavioral, performance and other relevant data resulting from your interaction with our Services, and this data will contain Personal Information.

Generally, our service automatically collects usage information, such as visitor stats for our Sites and its components, and download and installation numbers for our App, similar to TV ratings that indicate how many people watched a particular show. We use this data in aggregate form, that is, as a statistical measure, and not in a manner that would identify you personally.

Cookies

Like many websites, we use cookies and other standard web technology to collect information for our own use, helping us to provide you with a good experience whilst allowing us to improve our Services. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your browser to enable our systems to recognize your browser and tell us how and when pages in our Sites are visited and by how many users. Most browsers have an option for turning off the cookie feature, which will prevent your browser from accepting new cookies, as well as allowing you to decide on acceptance of each new cookie in a variety of ways. We strongly recommend that you leave the cookies activated, however, because cookies enable you to take advantage of some of our Sites’ most attractive features. If you disable the cookie feature, you assume all responsibility for any resulting loss of functionality on our Sites.

HOW WE USE YOUR PERSONAL INFORMATION

  • In general, information and data (including Personal Information) you submit to us, or to third parties that support us in collecting information, is used by us to provide you and other users with the Services, to respond to requests that you make, to improve our Services and to better tailor the features, performance and support of the Services.
  • To provide you with the information and/or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes;
  • To carry out our obligations arising from any contracts between us;
  • To notify you about changes to our Services;
  • To provide you with announcements, notifications related to your use of the Services and other communications such as electronic newsletters, promotional e-mails or similar messaging.
  • We may create anonymized information from Personal Information by excluding information which enables you to be personally identifiable. We may use this anonymized information for internal purposes, such as analyzing usage patterns and user match statistics so that we may enhance the Services, and we also reserve the right to use and disclose such anonymized information at our discretion.
  • We do not disclose information about identifiable individuals to our advertisers, but we may provide them with aggregate information about our users. We may also use such aggregate information to help advertisers reach the kind of audience they want to target. We may make use of the data and information we have collected from you to enable us to comply with our advertisers’ wishes by displaying their advertisement to that target audience.
  • We use aggregated anonymous data on our users for our own research, advertising and promotional purposes and to provide reports and other products and services to Employers and other third parties and to promote and advertise our Sites and Services. For example, we may use such information to provide reports and information on personality types and ability levels for specific jobs, demographic findings in relation to particular types of occupation or particular employers etc. We will not disclose information about identifiable individuals in providing these activities, products and services.
  • Where you have been given an invitation to use the Application and/or Services by a recruitment agency or business, or your employer or a potential employer, your game, test and training program data as well as our resulting assessment of your abilities and traits and such other information as you have provided to the Services will be shared with that business, and such information will contain Personal Information. We are not responsible for the manner in which any such business uses such information. They should have provided you with their own data policy in respect of their use of your Personal Information.

LIMITED DISCLOSURE OF YOUR PERSONAL INFORMATION TO THIRD PARTIES

Except as otherwise stated in this Privacy Policy, we do not disclose to or share your Personal Information with third parties, unless you ask or authorize us to do so.

We may provide your Personal Information to third party service providers and suppliers who work on behalf of or with us to provide you with some of the services, functionalities and features of the Services and to help us communicate with our users. However, these service providers and suppliers do not have any independent right to use this information except to help us provide the Services.

In addition, we may disclose some or all of your Personal Information in the following general circumstances:

  • We may disclose your Personal Information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the Companies Act 2006.
  • In the event that we sell or buy any business or assets, in which case we may disclose your Personal Information to the prospective seller or buyer of such business or assets.
  • If the Company or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
  • If we are under a duty to disclose or share your Personal Information in order to comply with any legal or regulatory obligation or request.
  • In order to apply or enforce our Terms of Use and other agreements or to investigate potential breaches; or
  • To protect the rights, property or safety of the Company, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

CHOICES REGARDING YOUR PERSONAL INFORMATION

You may change your Personal Information (e.g. name and email address) by logging into the Services and editing your profile information.

We may provide you with the opportunity to ‘opt-out’ of having your personally identifiable information used for certain purposes, when we ask for this information.

We may send newsletters, promotional communications or other similar messages to our users on our behalf and on behalf of our partners. You may opt-out of receiving such messaging by following the instructions included in each message. We may also offer you an opportunity to opt-out of certain communications by logging into the Services and editing your settings.

We may send you service-related announcements when we believe it is necessary to do so. Generally, you may not opt-out of these announcements, which are not primarily promotional in nature. If you do not wish to receive these announcements, you have the option to deactivate your account.

We may notify you when your Personal Information is collected by any third party that is not our agent/service provider, so you can make an informed choice as to whether or not to share your information with that party.

You may request that your account be terminated and that your Personal Information be deleted by sending an email to hi@mindx.co. Any termination of your account may involve deletion of your account information from our live databases and all the information and data stored for such account in the Services We will not have any liability whatsoever to you for any termination of your account or related deletion of your information.

When we delete Personal Information that we have collected from or about you, it will be deleted from our active databases but may remain in our archives.

WHERE WE STORE YOUR PERSONAL DATA

The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (EEA). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. These staff may be engaged in the fulfilment of your request, order or reservation, the processing of your payment details and the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing. The Company will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.

The transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our Sites; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

FEEDBACK

If you provide feedback about the Services to us, we may use and disclose such feedback for any purpose, provided we do not associate such feedback with your Personal Information. We will collect any information contained in such feedback and will treat the Personal Information in it in accordance with this Privacy Policy. Please note that you will receive no compensation or payment of any kind for any feedback you provide or for any use we may make of your feedback.

YOUR RIGHTS

You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. Where applicable, you can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data or by editing your account information. Our Sites may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates (including, but not limited to, websites on which the App or the Services are advertised). If you follow a link to any of these websites, please note that these websites and any services that may be accessible through them have their own privacy policies and that we do not accept any responsibility or liability for these policies or for any personal data that may be collected through these websites or services, such as contact and location data. Please check these policies before you submit any personal data to these websites or use these services.

ACCESS TO INFORMATION

The Data Protection Act 1998 gives you the right to access information held about you. Your right of access can be exercised in accordance with that Act. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.

CHANGES TO OUR PRIVACY POLICY

This Privacy Policy may be updated from time to time as our services change and grow. Any changes we may make to our Privacy Policy in the future will be posted on this page and, where appropriate, notified to you by SMS OR by e-mail OR when you next start the App or log onto the Sites. The new terms may be displayed on-screen and you may be required to read and accept them to continue your use of the App or the Services.
